1]         Since 2004, the employment goal [or parity] for persons with disabilities [PWDs] in California State government has been 16.6 percent. This is based on California disability labor force data from the 2000 U.S. Census [a]. Between 1996 and 2004 it was 11.4% [based on California disability labor force data from the 1990 U.S. Census][b1].

PWDs are significantly underrepresented in the following 17 departments [which employ nearly two-thirds of all state employees][d].

For the period July 1, 2006 through February 28, 2007, 40 state departments [out of 93 that have 30 or more employees] have used LEAP [e].

7]         Adverse Actions:

For the first nine months of Fiscal Year FY2000-01 [the most recent information available], PWDs comprised 7.2 percent of the State government work force.  At the same time, 9.7 percent of all adverse actions were initiated against PWDs [f].

8]         Discrimination Complaints:

For the calendar year 2004, 1636 discrimination complaints were initiated against State departments.  Of that total, 12.9 percent were on the basis of disability [g]. The disability employment rate for this time period was between 7.5 and 8.4 percent [cutting across two fiscal years][a].

9]         Disability Advisory Committees [DACs]

State law [Government Code Section 19795[b] has required all State departments to have DACs for many years and more recently they are also required by the Governor's Executive Order S-04-05 [6/22/05].

At the end of FY 2004-05, over 140 departments were reviewed to confirm they had a DAC. Over 30 did not and another 30-plus did not respond [h].

10]       Employment Goals For PWDs

Departments are required to submit goals to the SPB for the employment of PWDs if their disability representation is less than 13.3% [80% of the California disability labor force representation of 16.6%].

Forty departments had a lower disability representation in 2006 than they did in 2005. Thirty-seven departments had a higher disability representation in 2006 than they did in 2005.
